Welcome to the Pride of Herndon Marching Band website (“Site”), operated by the Herndon High School Band Parents Association (“HHSBPA”).

1. Use of the Site

You may use the Site only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations. You agree not to misuse the Site or interfere with its proper operation.

 

2. Purchases and Donations

All sales of tickets and merchandise are final. Refunds are not provided except on a case-by-case basis at the discretion of HHSBPA. Donations are non-refundable.

 

For donations, users are redirected to the HHS Band Parents PayPal Charitable Giving Fund and are subject to PayPal’s Giving Fund Donor Terms of Service.

 

3. User Content

Users may submit comments or photos on blog posts (“User Content”).. All User Content must comply with the Fairfax County Public Schools guidelines, available on the FCPS Digital Citizenship site. By submitting User Content, you grant HHSBPA a non-exclusive, royalty-free, revocable license to display and use such content solely in connection with the Site and its related activities. HHSBPA reserves the right to remove User Content at any time and for any reason without notice.

 

4. Links To Third-Party Sites

The Site may contain hyperlinks to websites operated by third parties. These links are provided for convenience only. HHSBPA does not control and is not responsible for the content, privacy policies, data retention practices, or other practices of third-party websites.

 

5. Intellectual Property

All content on the Site, including logos, images, text, and designs, is owned by or licensed to HHSBPA and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or use any materials without prior written permission. For permission, contact communications@herndonband.org.

 

6. Limitation of Liability and Disclaimer of Warranties

Your use of the Site is at your own risk. The Site and all information provided on it are provided “as is,” and “as available” without warranties of any kind, either express or implied including, but not limited to , warranties of merchantability, fitness for a particular purpose and non-infringement. To the fullest extent permitted by Virginia law, HHSBPA, its officers, directors, agents, and volunteers shall not be liable for any damages of any kind arising out of or relating to your use of the Site, including direct, indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits liability for gross negligence or willful misconduct to the extent such limitation is prohibited by law.

 

7. Changes to These Terms

HHSBPA may update these Terms of Use at any time without notice. Changes will be effective upon posting to the Site. Continued use of the Site after any changes constitutes acceptance of the revised Terms

 

8. Governing Law and Venue

These Terms of Use are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any legal action arising from or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Fairfax County, Virginia.
